These Terms & Conditions govern the provision of consultancy services by Black Mountains Tree Consultancy, operated by Johann Wilsker. By instructing us to carry out any work, you accept these terms in full.

2. Services Provided
We provide arboricultural consultancy services, including but not limited to:
- Tree Safety & Condition Surveys
- BS5837 Planning Surveys
- Decay Investigations
- Woodland & Habitat Management
- Soil Assessment & Improvement
The exact scope of work will be defined in your quotation or proposal.
3. Client Responsibilities
We provide arboricultural consultancy services, including but not limited to:
- Providing accurate information about the site and project
- Ensuring safe and legal access to the site on the agreed dates
- Informing us of known hazards (e.g. unstable trees, ground conditions, protected species)
- Gaining permissions from landowners or authorities if applicable
- Complying with planning, environmental and access regulations
Delays caused by the client may result in additional charges.
4. Fees & Payment
- All quotations are valid for 30 days
- Payment is due within 14 days of invoice unless otherwise agreed
- We reserve the right to charge late payment interest at 4% above the Bank of England base rate

Additional charges may apply for:
- Return site visits
- Revisions outside the original agreed scope
- Emergency or expedited reporting
Payment methods will be outlined on your invoice.
5. Cancellations & Postponements
- If you need to cancel or reschedule a site visit, please provide at least 48 hours’ notice
- Cancellations with less than 48 hours’ notice may incur a charge of up to 50% of the quoted fee
- Black Mountains Tree Consultancy reserves the right to cancel or postpone services due to unsafe site conditions, adverse weather or illness, with full notice and rescheduling
6. Reports & Advice
- Reports are prepared in good faith using the available evidence at the time
- Tree condition can change rapidly; findings are valid from 1 year from date of inspection unless otherwise stated.
- Reports are provided for the client’s use only and may not be copied or passed to third parties without written permission
- No liability is accepted for third-party reliance on our reports
7. Insurance & Liability
- We maintain appropriate Professional Indemnity and Public Liability Insurance
- Our liability is limited to the value of the services provided, except in cases of proven negligence

We are not liable for:
- Damage or loss due to tree failure after the reinspection date
- Consequential losses resulting from advice, delays, or report use
- Any actions taken based on a misinterpretation of our reports
8. Intellectual Property
All written reports, drawings and documentation remain the intellectual property of Black Mountains Tree Consultancy unless otherwise agreed. Use or reproduction beyond the project scope is not permitted without prior consent.
9. Confidentiality
We treat all client information and site details as confidential and do not share information without permission, except where required by law or regulatory obligations.
10. Legal Jurisdiction
These terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
